Privacy Policy

Understanding our terms of service and data protection guidelines. Please review the details regarding your rights and our obligations.

Effective Date: November 1, 2025

Last Updated: November 1, 2025

At ApexOn ("we", "our", "us"), we respect your privacy and believe in being transparent about how we handle your data. This Privacy Policy explains how we collect, use, and disclose information when you use our Services, which include our Apex Note application (the "App") and our website https://www.apexon.app/ (the "Site"). By using our Services, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

We collect information to provide and improve our Services to you.

a. Information You Provide

We collect information you directly provide when you use our Services. This includes basic profile details from social logins (like your email, name, and avatar), and user-generated content (like texts you create in our App). Your content is private by default, not viewable on the internet or accessible to other users unless you choose to share it. We may keep records of your communications with us (e.g., support inquiries or website form submissions) and any other information you voluntarily provide.

b. Information Collected Automatically

We collect information about how you interact with our Services, such as features used (e.g., AI interactions, specific tools), how frequently you use them, and your interactions with system notifications or website elements. This helps us understand user behavior and improve the Services. We also use cookies and similar technologies to gather data about your interactions, track usage patterns, remember preferences, and measure campaign effectiveness.

c. Information from Third Parties (with your consent)

We receive certain information from third-party services that you choose to use with our services or that help us provide our functionalities. This includes profile details like your name, email, and avatar via social logins (e.g., Google, Apple). For purchases, your payment details are processed through the Apple App Store or Google Play Store billing systems. We use RevenueCat only to manage subscription status and records. We do not have access to your full payment details but we keep a record of your purchases for subscription management and accounting purposes. We also use third-party analytics tools (e.g., Google Analytics) to understand how our Services are used, collecting interaction data without generally combining it with your directly identifiable personal information unless you explicitly consent. Please note, this Privacy Policy covers data we process directly; we aren't responsible for the privacy practices of other third-party websites or services you encounter, and we encourage you to review their policies.

d. Permissions Requested

Our mobile applications may ask for specific permissions on your device to enable core functionalities. These can include access to the camera for photos, microphone for audio recording or speech-to-text, storage for media files, and notifications for alerts. You can manage these permissions directly through your device's settings, though revoking them may affect certain app features.

2. How We Use Your Information

We use collected information to operate, maintain, and improve our Services, provide functionalities and manage your account. We may also use your information for communication, sending you important system notifications, updates, reminders, and, if you've opted in, marketing and promotional content. We also analyze how users interact with our Services for troubleshooting, identifying popular features, and optimizing overall user experience. Additionally, we process information as necessary to comply with applicable laws, app store policies, and legal obligations.

3. Data Sharing and Disclosure

We do not sell your personal data, but we may share it under specific circumstances. We use trusted third-party service providers to perform functions on our behalf, including AI technology, database hosting, and other operational support; these providers are contractually obligated to protect your information. For purchases within our Services, third-party payment processors (like RevenueCat) directly handle your payment details, and their practices are governed by their privacy policies and PCI-DSS standards. We will also share your information with your explicit consent, or when legally required to comply with law, court order, or to protect the rights, property, or safety of ApexOn, our users, or the public. Finally, in the event of a merger, acquisition, or sale of assets, your personal data may be transferred as part of that transaction, and we'll notify you beforehand.

4. Data Security

We implement appropriate technical and organizational measures to safeguard your personal data from unauthorized access, use, or disclosure. While no method of transmission over the internet or electronic storage is completely secure, we continuously work to protect your data through industry-standard practices. These include encryption, secure storage, strict access controls, and regular security reviews. Some of our infrastructure and trusted service providers may be located in other countries, which means your information may be transferred to and processed on servers outside your country of residence. We rely on reputable partners and industry-standard safeguards to help ensure your data remains secure and protected.

5. Data Retention and Deletion

We offer clear options for data retention and deletion. You can permanently delete your account through our App's settings. Once you submit a deletion request, your account will enter a 7-day pending deletion period. During this time, you may log in again to automatically restore your account if you change your mind. After the 7-day period, all associated data will be permanently deleted and cannot be recovered. This includes your user-generated content, metadata, account settings, and AI-processed data. We will send you an email confirmation once the deletion is completed. Any notes or other content created before signing in will be securely merged into your account once you sign in. This ensures all your previous content remains accessible under your account. You may also delete your notes or other saved items within the App at any time.

6. Your Choices and Rights

You have clear control over your information within our Services. You can access your profile through your account settings and manage notification settings directly within the App or through your device settings. You may also permanently delete your account using the "Delete Account" option. You can manage permissions such as camera and microphone access through your device's operating settings. Please note that disabling certain permissions may affect some App functionalities, such as recording or transcription features. You may opt out of marketing communications at any time by following the unsubscribe link in those emails or by contacting us directly. However, we may still send you non-promotional messages, such as account or security notifications. If you are a resident of the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict processing, object to processing, and data portability. If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) and California Civil Code Section 1798.83, including the right to request information about how your personal data is collected, used, and shared. California residents under 18 who are registered users may also request the removal of content or information they have publicly posted under California Business and Professions Code Section 22581. For your security, we can only process privacy-related requests after verifying your identity through your email address. To exercise any of these rights, or to withdraw your consent, please contact us using the details provided in the "Contact Us" section below.

7. Children Usage Restrictions

Our Services do not address anyone under the age of 13. Protecting children's privacy is important to us. We do not knowingly collect or keep personal information from anyone under 13 years old, and no part of our Services is designed to attract users under that age. If we find out a user is under 13, we will take steps to remove their personal information from our databases and stop them from using the Services. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.

8. Changes to This Privacy Policy

We may update our Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any significant changes by posting the new Privacy Policy on this page and updating the "Last Updated Date" at the top. We encourage you to review this Privacy Policy periodically for any changes.
